These Terms of Use ("Terms") govern your access to and use of the website mariansan.io (the "Site"), operated by Marian Sanjur ("I", "me", or "my") from the Republic of Panama.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About the Site

mariansan.io is my personal portfolio. It contains biographical information, project descriptions, and a changelog/feed of my work ("Now"). The Site is provided for informational purposes only. Nothing on the Site constitutes an offer of goods or services, and no commercial products are sold through it.

The opinions and views expressed on the Site are strictly my own and do not represent the positions of my current or former employers, clients, or any organization with which I am affiliated.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Site.

3. Use of the Site

You agree to use the Site lawfully and respectfully. In particular, you agree not to:

  • Use the Site in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Site, its servers, or related infrastructure.
  • Interfere with, disrupt, or overload the Site (e.g., denial-of-service attacks, excessive scraping, automated crawling against stated restrictions).
  • Reverse engineer, decompile, or otherwise attempt to extract underlying source code, except as permitted by law.
  • Use the Site to transmit malware, spam, or harmful code.
  • Impersonate me or misrepresent your affiliation with me.

I reserve the right to restrict or terminate access to the Site at any time, without notice, for any reason.

4. Intellectual property

All content on the Site — including text, articles, graphics, logos, code samples, design, photographs, and the "mariansan" name — is owned by Marian Sanjur or licensed to me, and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site for personal, non-commercial informational purposes. You may not copy, reproduce, distribute, modify, publicly display, republish, or create derivative works from any part of the Site without prior written permission, except:

  • Brief quotations for commentary, criticism, news reporting, or academic purposes, with proper attribution and a link back to the original Site URL.
  • Personal sharing via social media links or standard share functionality.
  • Any materials explicitly made available under an open-source or Creative Commons license (in which case those license terms control).

All rights not expressly granted are reserved.

5. Contact by email

The Site displays an email address (mailto: link) for general correspondence. Writing to me does not create any business, contractual, consulting, or advisory relationship, and does not establish any duty of confidentiality on my part unless explicitly agreed in writing.

Unsolicited proposals, ideas, or confidential information sent via email are received on a non-confidential basis, and I am free to disregard them without liability.

6. Third-party services and links

The Site relies on third-party infrastructure and services, including Vercel (hosting), Google Analytics 4 (analytics), and CookieYes (consent management), and may link to external websites, articles, repositories (e.g., GitHub), or social profiles (e.g., LinkedIn). I do not control and am not responsible for third-party services or their content. Your use of third-party services is governed by their own terms and policies.

7. AI-generated and automated content

Portions of the Site, including the changelog/feed and other content, may reference or include outputs generated or assisted by AI systems. You acknowledge that such content may be inaccurate, incomplete, or imperfect, and must not be relied upon for legal, financial, medical, technical, or other professional decisions. Any use you make of content on the Site is at your sole risk.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

I do not warrant that the Site will be error-free, secure, or continuously available, or that any defects will be corrected. You use the Site at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MARIAN SANJUR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MY TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those cases, the above limitations apply to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold me harmless from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of:

  • Your use or misuse of the Site,
  • Your violation of these Terms, or
  • Your infringement of any third-party right.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Panama, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Panama City, Panama, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

If you are a consumer resident in the European Economic Area or the United Kingdom, nothing in these Terms affects your mandatory statutory rights.

12. Changes to these Terms

I may modify these Terms from time to time. The "Last updated" date reflects the latest version. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

13. Language

These Terms are provided in English and Spanish. Both versions are intended to have equivalent meaning. In case of any discrepancy, the English version shall prevail.

14. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding the Site and supersede any prior understandings.
